The responsibility of public decision-makers

OBJECTIVE :

This course will enable public officials (decision-makers or operational staff) to:

  • understand the evolution of the law of liability
  • understand the notion of fault
  • identify the risks of jeopardizing the personal liability of the individual

COURSE DURATION AND TIMETABLE :

This course last one day (5 hours)

GENERAL APPROACH :

A focus on the particular liability of the public official and assessing the legal risk inherent to their decisions.

PREREQUISITE :

Course level : Advanced, or with prior completion of the course on the responsibility of decision-makers.

This course is for:

  • personnel responsible for awarding contracts or making deals
  • leaders/elected officials with a responsibility towards community life

CONTENT :

  • The State, a liable legal entity:
    • The evolution of positive law
    • The liability of the fault State
    • No-fault liability
  • Understanding the different liabilities:
    • The notion of fault
    • Criminal liability
    • Civil liability (the state or the individual?)
    • The field of disciplinary/professional sanction
  • Questioning of the personal liability of the officer:
    • Delegation and transfer of liability
    • De facto management, action to fulfill liabilities
    • Trading in influence, crime of favoritism, illegal taking of interest, misuse of social assets
